General Terms and Conditions of Sale for the SoundBreathing application

Preamble

The purpose of these General Terms and Conditions of Sale (hereinafter the "GTCS") is to define the terms and conditions of sale of the services offered by the SoundBreathing mobile application (hereinafter the "Application"), published by SYNAPPS SAS, whose registered office is located at C/O BURO Club Martinique, Imm. Avantage, Entrée B 11 rue des Arts et Métiers Lot. Dillon Stade 97200 Fort de France, registered in the Trade and Companies Register under number 789 834 025 (hereinafter the "Publisher").

2. Acceptance of the General Terms and Conditions

Any subscription to the paid services offered by the Application implies full acceptance of these GTC. By subscribing to a paid service, the user (hereinafter the "User") accepts these GTC without reservation.

3. Description of the Services

SoundBreathing offers paid services enabling Users to access guided breathing exercises, personalized relaxation programs, progress tracking and advanced features (hereinafter the "Services").

4. Subscription terms

The Services are accessible via a monthly or annual subscription. The subscription terms, including the prices and duration of the subscriptions, are specified in the Application at the time of subscription.

5. Prices and Payment

The prices of the Services are indicated in euros, inclusive of all taxes. Payment is made by credit card or via the payment platforms available on the Application (e.g. Google Pay, Apple Pay). The User authorizes the Publisher to debit his/her account for the amount of the chosen subscription at the frequency indicated (monthly or annually).

6. Renewal and Termination

Subscriptions are automatically renewed on expiry for a period identical to that initially subscribed, unless the User cancels. The User may cancel his subscription at any time via his account settings in the Application. Any period started is due in full and no refund will be made pro rata temporis.

7. Right of Withdrawal

In accordance with current legislation, Users have a period of fourteen (14) days from the date of subscription to exercise their right of withdrawal without having to justify their decision or pay any penalties. To exercise this right, the User must notify the Publisher in writing (email or post) of his/her decision to withdraw. If the User has begun to use the Services before expiry of the withdrawal period, he expressly waives his right of withdrawal.

8. Liability

The Publisher undertakes to provide the Services in accordance with these GTC. However, the User uses the Services at his/her own risk and the Publisher shall not be liable for any direct or indirect damage that may result from the use of the Application or the Services.

9. Intellectual Property Rights

All content, elements and services of the Application are protected by intellectual property rights and are the exclusive property of the Publisher or its partners. Any reproduction, representation, modification, publication or adaptation of all or part of the elements of the Application, by whatever means or process, is prohibited without the prior written authorization of the Publisher.

10. Protection of Personal Data

The Publisher undertakes to protect the privacy of its Users and to comply with current regulations on the protection of personal data. The procedures for collecting, processing and storing Users' personal data are detailed in the Application's Privacy Policy.

11. Modification of the GTC

The Publisher reserves the right to amend these GTC at any time. Amendments will come into force as soon as they are posted on the Application. The User is invited to consult the GTC regularly to take note of any changes.

12. Applicable law and jurisdiction

These GTC are governed by French law. Any dispute relating to the interpretation and performance of these GTS will be subject to the exclusive jurisdiction of the French courts.

2. Acceptance of the GCU

Use of the Application is subject to acceptance of these GTCU. By downloading, installing and/or using the Application, the user (hereinafter the "User") accepts these GCU without reservation. If the User does not accept the GCU, he/she must refrain from using the Application.

3. Description of the Application

SoundBreathing is a mobile application that offers its users guided breathing exercises to help with relaxation, stress management and improving general well-being. The App offers various features, including personalized breathing programs, progress tracking, and breathing reminders.

4. Access to the Application

The Application can be downloaded free of charge from application download platforms compatible with iOS and Android systems. Access to certain features of the Application may require an internet connection and/or the creation of a user account.

5. Use of the Application

The User undertakes to use the Application in accordance with its purpose and these GCU. In particular, the User undertakes not to:
- Use the Application for illegal, fraudulent or malicious purposes;
- Infringe the intellectual property rights of the Publisher or third parties;
- Disrupt or attempt to disrupt the proper operation of the Application.

6. Creating an Account

In order to access certain features of the Application, the User may be required to create an account by providing accurate, complete and up-to-date personal information. The User is responsible for the confidentiality of his/her login details and all activities that take place under his/her account.

7. Protection of Personal Data

The Publisher undertakes to protect the privacy of its Users and to comply with current regulations on the protection of personal data. The procedures for collecting, processing and storing Users' personal data are detailed in the Application's Privacy Policy.

The Application and each of its components (texts, images, logos, videos, software, databases, etc.) are the exclusive property of the Publisher or its partners.
