Avantage, Entrée B, 11 rue des Arts et Métiers Lot Dillon Stade 97200 Fort de France, registered with the Trade and Companies Registry under number 789 834 025, and whose VAT number is FR14931524110 (hereinafter ‘SYNAPPS’ or ‘we’) is committed to protecting and respecting your privacy in connection with your use of our website www.sound-breathing.com (the ‘Site’), our mobile applications (the ‘Apps’) and our other products and services (the Site, the Apps and the other products and services are collectively referred to herein as the ‘Services’).

This Privacy Policy sets out how we manage information and data that directly or indirectly identifies you (‘Personal Data’) when you use our Services. Please read the following carefully to understand our practices regarding your Personal Information.

 

1. The Personal Information we process

    1. Data that you provide directly.

When you use our Services, in particular when you create an account, connect to it, view our videos and practice the exercises  you are asked to provide us with certain information in the nature of Personal Data.

This information includes, to the extent necessary and without this list being restrictive:

- The Personal Data required to register for our Services, i.e. your email address and password, and, to benefit from our paid services, your bank details;
- You may also decide to provide us with additional information on our Services, such as your gender, first name, surname, profile photo and address. Unlike the aforementioned information, this additional information is not compulsory in order to validate your registration for the Services. It does, however, enable us to personalize our relationship;
- Personal Data that you provide to us in order to contact us, in particular via our contact email adress, such as your email address, the content of your request and any attachments provided, your telephone number, etc. We may ask you for additional information when you report a problem with our Services, with a view to resolving this problem;
- The IP address, device model, browser and language of the device you use to connect to the Services; A copy of any correspondence (including email) you may send to us;
- Where applicable, your e-mail address for the purpose of subscribing to our newsletters. If you do not wish to receive marketing emails, follow the unsubscribe instructions included in each email sent. We will then remove you from our mailing list;
- Where applicable, your responses to surveys in which we invite you to participate, as well as the content of your publications on our Site. This information may be used for research and analysis of user behavior in order to improve our Services.
- Where applicable, the Personal Data you provide to us in order to participate in a competition or one of our sponsored promotions, in order to validate your registration;
- Details of transactions you carry out through our Services and orders you place through our Services.
- Details of your visits to the Site and Apps and in connection with the use of the Services, including, but not limited to, traffic data, location data, resources accessed, weblogs and other communication data, if required for our own billing purposes;
- Time spent on the Services, including the list of meditation sessions viewed and your preferences;
- Information from your Facebook or Instagram profile if you choose to connect to our services through Facebook or Instagram.


    2. What we collect automatically

a. Personal Data linked to social networks

When you connect to our Services via your Facebook account, we collect your email address, surname, first name, gender and your Facebook identifier, as entered by you when you created your Facebook account. We will also have access to some of the data in your Facebook account in accordance with the terms and conditions of use of the relevant social network.

b. Your use of our Services

Log files enable us to record your use of the Services. Our technical team collects log file information from all our users, which we use to make improvements to our Services and to inform us about how users use the Services (e.g. number of meditation sessions completed, meditation time, meditation history, etc.). This information is published in your user account.
If you receive an html version of our newsletters, we will be notified that you have opened the email newsletter and we will store this information. Your clicks on the links in the newsletter are also recorded. These and the opening statistics are used in aggregate form to give us an indication of the popularity of the content and to help us make decisions about the content and its formatting in the future.

c. Cookies

During each of your visits, we may collect, in accordance with the applicable legislation, information relating to the devices on which you use our Services or the networks from which you access our Services, such as in particular your IP addresses, connection data, types and versions of Internet browsers used, operating systems and platforms, data concerning your browsing path on our Site and our Apps, download errors, the content you access or consult, the advertising identifier of your device, etc. In order to do this, we make use of cookies.

What is a cookie?

A cookie is a small text file recorded and/or read by your browser, stored in the cookies folder on the hard disk of your device (PC, laptop or smartphone), and deposited by the websites you visit. It contains a unique and anonymous identifier.

What cookies do we use?

When we provide Services, we want to make them easy to use, simple, practical, useful and reliable. To do this, we use several categories of cookies:

- Absolutely necessary cookies, to enable you to move around the Site and Apps and use their basic functions. These cookies are essential for using our Services;
- Security cookies;
- With your consent, authentication cookies, which exempt you from having to provide your login and password each time you connect to our Services;
- With your consent, cookies for personalizing the user interface: these cookies make it possible to remember a user's preferences (first name, language preference, for example);
- With your consent, analysis and performance cookies, which enable us to recognise and count the number of visitors to our Site and Apps and to collect information on how they are used. This enables us to improve the way in which our Site and Apps function and, more generally, the content of our Services. These cookies also enable us to measure the effectiveness of our marketing efforts;
- With your consent, sharing cookies on social networks: when you share content from our Services on a social network, via a sharing button, a cookie will be placed on your terminal if you have accepted this type of tracking. As long as you have not clicked on the share button and then clicked a second time on the desired social network, no cookie will be placed on your terminal. 
- With your consent, advertising or targeting cookies are used to record your visit to our site, as well as the pages you have consulted and the links you have followed. This information enables us to display relevant advertisements according to your centres of interest, to limit the number of times the same advertisement is displayed and to help measure the effectiveness of advertising campaigns. They may be shared with third parties, such as advertisers, advertising agencies or networks.
Cookies will be deleted by us after a period of 13 months from their date of deposit.

Placement of cookies by third parties

The third parties we use to track your use of our Services or for marketing purposes may use cookies, which we do not control.
Similarly, when you visit a page with content hosted by a third party (for example, YouTube videos) or use some of the links to social networking sites (for example, the ‘share’ button), these sites may place cookies on your computer.

2. Why do we use your Personal Data?

We process your Personal Data for the following purposes, which are justified by the performance of our contractual obligations and the satisfaction of your requests, which constitutes the legal basis for the processing concerned:

- to enable you to access our Services and to provide you with the information and Services requested 
- to provide you with customer support
- to collect your payments;
- to inform you of changes to our Services;
- enable you to use the interactive features of our Services if you so wish;
- provide you with a history of meditations carried out by them as well as statistical information on your use of our Services;
- send you, by email, messages relating to the use of our Services or coaching/advice in order to support you in your practice of meditation and to motivate you;
- analyze messages exchanged by you with other members of our community via the Site or the Apps in order to ensure that our general terms and conditions of use are complied with.
The processing of your Personal Data is also in other cases justified by our legitimate interest, which then constitutes the legal basis for the processing in the following cases:
- to improve and optimize our Site and our Apps, in particular to ensure that our content is displayed in a way that is suitable for your computer or other device;
- to manage our Site and Apps and to carry out internal technical operations as part of problem solving, data analysis, tests, research, analyses, studies and surveys to ensure the security of our Site and Apps and to improve their features);
- to compile statistics on your use of our Services in order to provide you with content tailored to your needs and to improve our Services;
- to send you by email or SMS, in accordance with the applicable legal provisions, messages concerning services similar to those you have used or to send you occasional special offers concerning them in order to promote our Services;
- to manage notices, incidents, complaints and disputes to enable us to ascertain, exercise or defend our legal rights;
- measure the performance of our marketing efforts to develop and sustain our business.
Your Personal Data is also processed to enable us to respond to your requests for rights of access, rectification and opposition, or relating to your other rights with regard to Personal Data. This processing is then based on compliance with our legal obligations.
Finally, the processing linked to certain cookies (see point 2 above) or relating to the receipt by email or SMS of information from third parties is based on your consent. You may withdraw your consent at any time, as this is the only legal basis applicable.


3. To whom are your Personal Data transmitted?

Personal Data is processed internally by duly authorized persons, within the limits of their respective responsibilities.

It may also be communicated to the following external recipients:

- financial organizations that hold accounts that have been transferred
- competent administrative and judicial authorities, such as tax authorities, in order to enable SYNAPPS to fulfil its legal obligations in this respect, to apply or enforce its agreements with you, or to protect the rights, property or safety of SYNAPPS, our customers and all third parties;
- judicial and legal officers in the course of their debt collection duties;
- subcontractors (in particular IT service providers) and external service providers (such as auditors, legal advisers, trustees, providers of analytical solutions or payment services, companies and organizations specializing in fraud protection and the reduction of the risk of non-payment, etc.), to the strict extent necessary and subject to the existence of contractual guarantees to ensure the security and confidentiality of the data;


4. How do we protect your Personal Data?

Personal Data collected by SYNAPPS is processed by it, in its capacity as data controller, in compliance with applicable data protection legislation (namely in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, - the GDPR -, as well as any subsequent regulations).

SYNAPPS undertakes to implement technical and organizational security measures likely to ensure the protection of Personal Data against the risks associated with the use of information systems, and in particular unauthorized access to this information. Except in the case of disclosure of your Personal Data as described in point 4 above, we do not provide your Personal Data to a third party without your express consent.
All information you provide to us through our Services is stored on our secure servers located in France. All payment transactions will be encrypted using SSL technology. Where we have given you (or where you have chosen) a password which enables you to access certain parts of the Services, you are responsible for keeping this password confidential. We ask you not to share a password with anyone. Unfortunately, the transmission of information via the Internet is not entirely secure. While we do our best to protect your personal information, we cannot guarantee the security of your information transmitted to the Services; any transmission is at your own risk.


5. How long do we keep your Personal Information

Your Personal Information is retained for a period of 10 years from the closure of your account or your last use of our Services if you have not closed your account, which is the applicable statute of limitations. This period may be extended for the duration of any legal or administrative proceedings that may be in progress.

However, as soon as your account is closed or after a period of two (2) years from your last use of our Services if you have not closed your account, your Personal Data is simply stored for archiving purposes in a secure manner to meet our legal obligations or, where applicable, to enable us to defend ourselves in court.  It is not communicated to third parties or used in any other way.


6. What are your rights regarding your personal data?

You have the right to obtain, free of charge:

- access to and rectification of your Personal Data;
- confirmation that your Personal Data is or is not being processed;
- information at least as to the purposes of the processing, the categories of Personal Data to which the processing relates and the recipients or categories of recipients to whom the Personal Data is disclosed;
- communication, in an intelligible form, of the Personal Data being processed, as well as any available information on the origin of the data.
You also have the following rights, within the limits provided by the applicable rules and subject to proving your identity:
- request the deletion of all or part of the data or a restriction on processing;
- object to the processing of your data
- exercise your right to the portability of your Personal Data.

You can access and modify your Personal Data at any time via your online account.
You also have the right to lodge a complaint with a supervisory authority such in the event of a breach or breaches of the rules applicable to the protection of personal data.

You have the right to ask us not to use your Personal Data for marketing purposes in order to send you information about our own Services. You may exercise your right to prevent such processing by following the opt-out instructions in the marketing material you receive or by contacting us at any time by email, or by withdrawing your consent directly on your user interface.

The Services may, from time to time, contain links to websites of our partner networks, advertisers and affiliates. If you follow a link to one of these sites, please note that these sites have their own confidentiality policies and that we decline all responsibility for the use made by these sites of the information collected when you click on these links. We invite you to read the confidentiality policies of these sites before sending them your Personal Data.


7. Children's privacy

The Services are designed for persons aged 18 and over. Children between the ages of 13 and 18 (or the age of majority in their country of residence) who are not emancipated (‘minors’) may use the Services, but use by minors must be made only under the supervision, control and with the consent of their legal representatives. We rely on parents and guardians to ensure that minors use the Services with an understanding of their rights and responsibilities as set out in the terms of use and sale applicable to the Services (the ‘Terms’). If you are a legal representative of a minor and you give your consent to the use of the Services by the child for whom you have legal responsibility, you agree to be bound by this Privacy Policy and the Terms. Children under the age of 13 are not permitted to use the Services. If you are under the age of 13, please do not attempt to access or use the Services. If you believe that we may have collected personal information from a child under the age of 13, please notify us at so that we may delete such information.


8. Changes to our Privacy Policy

SYNAPPS reserves the right to modify or update this Privacy Policy, or any of our other policies or practices, at any time, and will notify users of the Services by posting the modified or updated Privacy Policy on the home page of the Site or App in question. Any changes will be effective immediately upon such posting. Your continued use of the Services constitutes your agreement to comply with the Privacy Policy as amended. In certain circumstances (for example, if we wish to use your Personal Data for purposes other than those stated in our privacy policy at the time of collection), where necessary, we will personally inform you and/or seek your consent.
